This California Privacy Notice (the “Notice”) sets forth Diconium US, Inc. and its group of companies (“Diconium US”, “we”, “us” and “our”) disclosure obligations under California law, including the California Consumer Privacy Act of 2018 (“CCPA”) and the California Civil Code section 1798.83. This Notice provides the additional details regarding the information defined as ‘personal information’ under applicable California law and related to a California resident or household (“Consumers” and “you”) further referred to as “Personal Information.” This Notice describes the categories of Personal Information Diconium US has collected, the categories of Personal Information Diconium US has disclosed, the categories of Personal Information Diconium US has sold (if any), and a description of the Consumer’s rights.

This Notice does not cover the Personal Information we process as a ‘service provider’ in connection with your use of Diconium US’s products and services that have been deployed by one of our business customers, such as your organization. Our commitments as a service provider are set forth in the applicable agreement between Diconium US and your organization.

Your Consumer Rights under the CCPA

Under the CCPA, you may have the following consumer rights. Please note that these rights are not absolute and in certain cases are subject to conditions or limitations as specified in the CCPA:

Abbreviated Right to Know (Collection): You have the right to request, at no charge, that we disclose to you the categories and specific pieces of Personal Information Diconium US has collected in the prior 12 months.

Expanded Right to Know (Collection and Disclosure): You have the right to request that we disclose certain information about how we have handled your Personal Information in the prior 12 months, including the:

categories of Personal Information collected about you;

categories of sources from which we collected your Personal Information;

business and/or commercial purposes for collecting and disclosing your Personal Information; and

categories of third parties to/with whom your Personal Information has been disclosed/shared, including for a business purpose; and

Under California Civil Code section 1798.83, California residents who provide Personal Information in obtaining products or services for personal, family, or household use may request information about the Personal Information shared by Diconium US, if any, with other third parties for their own direct marketing purposes. If applicable, this information will include the identity and addresses of those third parties and the type of Personal Information.

In addition, a business subject to California Business and Professions Code Section 22581 must allow California residents under age 18 who are registered users of online sites, services or applications to request and obtain removal of content or information they have publicly posted. Your request should include a detailed description of the specific content or information to be removed. Please be aware that your request does not guarantee complete or comprehensive removal of content or information posted online and that the law may not permit or require removal in certain circumstances.

Web server logging

When you access our website, our web servers automatically capture information that is of a general nature. This includes:

  • The type of web browser and operating system used
  • The domain name of the Internet service provider
  • The IP address of the computer being used
  • The website from which you were directed to us

This only refers to information that does not make it possible to arrive at conclusions as to your identity. We use so-called “cookies”. Cookies are small text files that are stored by an Internet user’s browser on their hard drive when they visit a website. Web tracking

On this site, web analyses are used to determine the reach pursuant to Art. 6 Sect. 1 lit. f GDPR, to implement legitimate interests for the effective layout of promotional activities and public relations work. In conjunction with this, the collection of personal data is reduced to a minimum, given that in all cases the IP is anonymized as soon as your IP address is received by the respective web server. The controller does not merge this information with any other data, which would in particular make it possible to identify the user.

  • Use of the tag management system “Tealium”

Tealium IQ is a tag management system that loads measuring pixels from third party vendors onto the diconium website pages (e.g. the Webtrekk measuring pixel). To optimize the measuring pixel loading process, Tealium uses a cookie to record some data that are not personal. This cookie loses its validity after 12 months.

The Tealium cookie archives the following information:

Use of Google Analytics

This website uses Google Analytics, a web analysis service offered by Google Inc. Use of Google AdWords

This website uses Google AdWords, an analysis service provided by Google Inc. (“Google”). During this process, Google AdWords places a cookie onto your computer (“conversion cookie”), if you have been referred to our website by a Google advertisement. Use of YouTube plug-ins

For the integration of videos, we use the so-called “Expanded Data Protection Mode” of provider YouTube LLC, 901 Cherry Ave. San Bruno, CA 94066, USA. As a result, a cookie will not be stored on your computer until you play the video. According to YouTube, no personal cookie information is stored when embedded videos are played under the expanded data protection mode. Use of Google Maps

For the provision of location information, we use the Google Inc. product Google Maps. When Google Maps is integrated, data, in particular the IP address, is also transferred to Google. Google collects, processes and uses visitor data about the use of the map functions. Participants at events such as trade fairs or job exchanges can take part in a competition organized by the responsible person. Data processing only takes place for the purpose of drawing the winner and providing the prize. Any further use of the data will only take place with prior express consent.

2. Inclusion in the interest-related e-mail newsletter (Art. 6 para. 1 a GDPR)

As part of the competition, those affected can also register for an interest-related e-mail newsletter of the diconium group. Registration is not required for participation in the competition. The data will not be passed on for other purposes, in particular for other advertising measures or a sale of the data.

A deletion of the lottery data takes place in principle after the drawing of the winners and its announcement. The data of the winners will be stored until the complete transmission of the prize and then deleted.
